Este artículo explora las mutuas relaciones entre teoría del Derecho y teoría de la legislación en la actualidad. A partir de la constatación de tres exigencias recurrentes —mayor atención a la legislación por parte de una teoría del Derecho tradicionalmente centrada en la adjudicación, desarrollo de una teoría de la argumentación específ ica para el ámbito de la legislación y mayor relevancia del control ético de la legislación— se subrayarán los presupuestos positivistas que inspiran la teoría de la legislación desde (...) los escritos de Bentham y se sugerirá la necesidad de adaptar la teoría de la legislación a los planteamientos del llamado neoconstitucionalismo. The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. En todo el mundo el populismo está transformando la democracia y asentando el llamado “giro punitivo”. Tan pronto como los politicos populistas se hacen con el poder siguen tres estrategias: colonización el poder, clientelismo en masa y legislación discriminatoria, basada en la escisión schmittiana del demos entre amigos y enemigos, según tres sistemas de clases sucesivos: el clásico clasismo economicista, el metaclasismo y el hiperclasismo. El feminismo punitivo es así el resultado coherente de la evolución del populismo punitivo.

En este trabajo se da noticia del último libro del profesor de Derecho penal, Eduardo Demetrio (UCLM) y se inscribe su crítica al llamado "Derecho penal del enemigo de Jakobs en el marco del auge del populismo en general y del populismo punitivo en particular.

The American Society for Bioethics and Humanities promulgated standards for clinical ethics consultants and is currently developing a national Quality Attestation in Clinical Ethics Consultation to assist facilities in ensuring that those performing clinical ethics consultations meet minimum standards. As the field moves towards such professionalization, there is a need to provide access to qualified clinical ethicists at a broad range of medical facilities. Currently, however, there are insufficient numbers of trained clinical ethicists to staff all healthcare facilities, and many (...) facilities lack the necessary resources to hire staff clinical ethicists. In this review, we describe several models for providing expert clinical ethics support to remote facilities that lack access to qualified clinical ethicists. Based on this analysis, we recommend telemedicine as the optimal model providing expert support to local ethics committee members tasked with providing clinical ethics consultation services. Surnames of grandparents were collected from children in the primary schools of the AlbanianItalian and Greek–Italian villages of southern Italy and Sicily. The coefficients of relationships by isonymy show almost no relationship with ethnicity. Ethnolinguistic minorities of southern Italy and Sicily are geographically subdivided into two main clusters: the first cluster comprises the Albanian, Croat and Greek communities of the Adriatic area; and the second cluster comprises the Albanian and Greek communities of the Ionian, Thirrenian and Sicilian areas.

Extensive research has documented the harmful effects associated with working for a narcissistic supervisor. However, little effort has been made to investigate ways for victims to alleviate the burdens associated with exposure to such aversive persons. Building on the tenets of conservation of resources theory and the documented efficacy of functional assets to combat job-related stress, we hypothesized that subordinates’ resource management ability would buffer the detrimental impact of narcissistic supervisors on affective, cognitive, and behavioral work outcomes for subordinates. We (...) found support for our hypotheses across three independent samples of US workers (N = 187; 199; 136). Specifically, higher levels of subordinate resource management ability attenuated the harmful effects of supervisor narcissism on employee-reported emotional exhaustion, job tension, depressed mood, task performance, and citizenship behavior. Conversely, these relationships further deteriorated for subordinates with lower levels of resource management ability. Overall, our research contributes to the literature that, although extensively documenting the harmful ramifications of narcissism in organizations, has neglected to investigate potentially mitigating factors. Una parte de la explicación del gran florecimiento en los EE. UU. de la filosofía analítica, particularmente la filosofía analítica del lenguaje, después de la segunda guerra mundial está sin duda en la amplitud de la comunidad de filósofos que un país grande en dimensiones permite. Pues conseguir un buen nivel de excelencia en la práctica de este modo de entender la filosofía requiere una amplia comunidad de colegas en que difundir y contrastar nuevas ideas. Conscientes de esto, los filósofos (...) analíticos continentales estamos embarcados en la tarea de ampliar recíprocamente nuestras comunidades, aprovechando el impulso del proyecto de mayor unión política europea. Aunque, a diferencia de lo que ocurría en EE. UU. en el tiempo a que nos hemos referido antes, existen importantes obstáculos culturales, hay buenas razones para ser optimistas. Existe claramente la voluntad, lo que ha permitido en la última década llevar a cabo con éxito proyectos tales como los de la European Society for Philosophy and Psychology y la European Society for Analytic Philosophy, así como establecer importantes lazos de conocimiento mutuo a través de pequeños seminarios bilaterales. Y existe también algo muy importante: el que los temas que más interesan a los filósofos del lenguaje continentales son muy próximos; algo que, aventuramos, lo explica parcialmente una formación que presta más atención a la tradición filosófica que la de nuestros colegas americanos. Estos temas incluyen típicamente la referencia, particularmente la referencia de expresiones indéxicas, así como cuestiones relativas a la objetividad, las condiciones de verdad, el realismo y el antirrealismo. We report three experimental studies of reasoning with double conditionals, i.e. problems based on premises of the form: If A then B. If B then C. where A, B, and C, describe everyday events. We manipulated both the logical structure of the problems, using all four possible arrangements (or ''figures" of their constituents, A, B, and C, and the believability of the two salient conditional conclusions that might follow from them, i.e. If A then C , or If C then (...) A . The experiments showed that with figures for which there was a valid conclusion, the participants more often, and more rapidly, drew the valid conclusion when it was believable than when it was unbelievable. With figures for which there were no valid conclusions, the participants tended to draw whichever of the two conclusions was believable. These results were predicted by the theory that reasoning depends on constructing mental models of the premises. (shrink)

Emotional disorder symptoms are highly prevalent and a common cause of disability among children and adolescents. Screening and early detection are needed to identify those who need help and to improve treatment outcomes. Nowadays, especially with the arrival of the COVID-19 outbreak, assessment is increasingly conducted online, resulting in the need for brief online screening measures. The aim of the current study was to examine the reliability and different sources of validity evidence of a new web-based screening questionnaire for emotional (...) disorder symptoms, the DetectaWeb-Distress Scale, which assesses mood, anxiety, obsessive–compulsive disorder, post-traumatic stress disorder, suicidality, and global distress. A total of 1,499 participants completed the DetectaWeb-Distress Scale and specific questionnaires for emotional disorder symptoms, suicidal behaviors, and well-being through a web-based survey. Results indicated that a structural model of 10 correlated factors fits reasonably better in comparison to the remaining models; measurement invariance for age and gender; good internal consistency ; and significant positive correlation with other measures of anxiety, depression, PTSD, or distress, and negative correlation with well-being measures, displaying support for convergent-discriminant validity. We also found that girls scored higher than boys on most of the subscales, and children had higher scores for social anxiety, specific phobia, panic disorder, and obsessive–compulsive symptoms, whereas adolescents scored higher on depressive symptoms, suicidality, and generalized anxiety, but the effect sizes were small to medium for all comparisons. The DetectaWeb-Distress Scale is a valid, innovative, and useful online tool for the screening and evaluation of preventive programs for mental health in children and adolescents. (shrink)

The purpose of this paper is to study Leonardo Polo's conception of the principle of identity. This identity is also called Origin; however, an adequate understanding of that expression requires a careful study of the way man comes to be aware of it.

This work considers the formalisation of the merging process of stratified belief bases, where beliefs are stored in different layers or strata. Their strata are ranked, following a total order, employing the value the agent using the belief base assigns to these beliefs. The agent uses an argumentation mechanism to reason from the belief base and obtain the final inferences. We present two ways of merging stratified belief bases: the first is defined by merging two strata without belief preservation, and (...) the second by merging two strata with belief preservation. For these operators, as layers merge, it is possible that some information has to be deleted from the stratum to maintain consistency. The latter merge operator will be defined as performing their actions so that information removed from the stratum is preserved after the merging by moving it to a stratum containing information perceived as having a lower value and where those beliefs may trigger a new revision, possibly starting a cascading effect. The potential for genetically modified (GM) crops to threaten biodiversity conservation and sustainable agriculture is substantial. Megadiverse countries and centers of origin and/or diversity of crop species are particularly vulnerable regions. The future of sustainable agriculture may be irreversibly jeopardized by contamination of in situ preserved genetic resources threatening a strategic resource for the world—s food security. Because GM crops are truly biological novelties, their release into the environment poses concerns about the unpredictable ecological and evolutionary responses that GM species (...) themselves and the interacting biota may express in the medium and long term. One of the consequences of these processes may be a generalized contamination of natural flora by GM traits and a degradation and erosion of the commonly owned genetic resources available today for agricultural development. GM plants carrying pharmaceutical and industrial traits will pose even more dangerous risks if released in the environment. (shrink)

Este trabajo se ocupa de tres aspectos principales de la filosofía del lenguaje de Wittgenstein: la teoría de la forma lógica, la teoría de los objetos del Tractatus y la crítica la teoría de los sense-data. Las tesis de Wittgenstein se compararán con el pensamiento de Leonardo Polo y, especialmente, con algunas afirmaciones de Polo en torno al nominalismo, la constitución de un lenguaje trascendental y el concepto de conocimiento en Wittgenstein.

Some properties and an algorithm for solving systems of multivariate polynomial equations over finite fields are presented. It is then shown how formulas of propositional logics can be translated into polynomials over finite fields in such a way that several logic problems are expressed in terms of algebraic problems. Consequently, algebraic properties and algorithms can be used to solve the algebraically-represented logic problems. The methods described herein combine and generalise those of various previous works.

This work begins by proposing the need for exploring the mode of being of mental disorders. It is a philosophical study in an Aristotelian perspective, with special emphasis on the anthropological–cultural dimension. It is difficult for such an inquiry to be carried out from within psychiatry or clinical psychology, committed as these fields are to their own logic and practical conditions. The issues are, in any case, more ontological than strictly clinical in nature. We therefore turn to Aristotle, and specifically (...) his doctrine of the four “causes,” to flesh out the social and cultural dimensions of mental disorders. In accordance with the present analysis, the material cause of disorders would be found in the contingencies of life; the formal cause would pertain primarily to the way clinical conditions themselves can serve as models of ‘being ill’ in our society; the efficient cause would correspond to the patients themselves, understood as active (albeit less than fully conscious) agents as well as to the pharmaceutical industry and the mass media; the final cause would be found in different adaptive functions served by the disorder. We conclude that the “mode of being” of most (if not all) mental disorders—in particular, their status as mental disorders—can often have more to do with cultural forms than with biological factors. School psychologists often break confidentiality if confronted with risky adolescent behavior. Members of the National Association of School Psychologists ( N = 78) responded to a survey containing a vignette describing an adolescent engaging in risky behaviors and rated the degree to which it is ethical to break confidentiality for behaviors of varying frequency, intensity, and duration. Respondents generally found it ethical to break confidentiality when risky adolescent behaviors became more dangerous or potentially harmful, although there was considerable variability between (...) respondents. Significant gender effects were found between male and female respondents for alcohol use, and a significant Form Type (i.e., male or female vignette) Frequency/Duration interaction was observed for antisocial behaviors. School psychologists could benefit from further training in ethical decision making because these ethical dilemmas are not always clear-cut. (shrink)

The idea that democracy is under threat, after being largely dormant for at least 40 years, is looming increasingly large in public discourse. Complex systems theory offers a range of powerful new tools to analyse the stability of social institutions in general, and democracy in particular. What makes a democracy stable? And which processes potentially lead to instability of a democratic system? This paper offers a complex systems perspective on this question, informed by areas of the mathematical, natural, and social (...) sciences. We explain the meaning of the term 'stability' in different disciplines and discuss how laws, rules, and regulations, but also norms, conventions, and expectations are decisive for the stability of a social institution such as democracy.
